Terms of Service

These Terms of Service ("Terms") govern your access to and use of Volleymate ("the Service"), operated by Reza Barzegar Gashti, Germany, during a private beta. By creating an account or using the Service, you agree to these Terms.

1. Access, Eligibility & Cost

Volleymate is currently in private beta and is only accessible by invitation or approval. You must be at least 16 years old to use the Service. Access is granted to professional volleyball organizations, coaches, analysts, and players affiliated with teams on the platform.

Volleymate is currently provided free of charge. No payment, subscription, or purchase is required or accepted at this time. If this changes in the future, we will update these Terms and notify users before introducing any paid features.

We reserve the right to grant, suspend, or revoke access at any time, including during the beta period.

2. Your Account

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You must sign in using Google OAuth — you are responsible for the security of your Google account.

You must not share your account with others or use another person's account without permission.

3. Acceptable Use

You agree not to:

• Upload content you do not have the right to share
• Attempt to reverse-engineer, scrape, or circumvent the platform's security
• Use the platform for any unlawful purpose
• Impersonate another person or organization
• Interfere with the platform's normal operation
• Upload malicious files or code

4. Your Content

You retain ownership of all content you upload to Volleymate, including scout files (.dvw), match videos, and team data ("Your Content"). By uploading content, you grant us a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the Service to you.

You are responsible for ensuring you have the right to upload and share the content you submit. Do not upload content that violates third-party rights or applicable law.

We do not claim ownership of Your Content and will not use it for purposes beyond operating the Service.

5. Intellectual Property

The Volleymate platform — including its software, design, analytics algorithms, and branding — is the exclusive property of its operator and is protected by copyright and other intellectual property laws. You may not copy, modify, or redistribute any part of the platform without our written permission.

6. Service Availability

We aim to keep Volleymate available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or emergency shutdowns that temporarily affect availability. We are not liable for losses arising from service interruptions.

During the beta period, features may change, be removed, or behave unexpectedly. Beta access is provided "as is."

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE — INCLUDING LOSS OF DATA OR PROFITS.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under German law.

9. Indemnification

You agree to indemnify and hold harmless the operator of Volleymate from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) content you upload, including any claim that it infringes or violates the rights of a third party (including a player's data protection rights); or (c) your violation of any applicable law. This does not affect any liability that cannot be limited or excluded under German law.

10. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or for any other reason, with or without notice. You may stop using the Service at any time.

Upon termination, your right to access the Service ends. We will handle your data as described in our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via the platform. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes will be subject to the exclusive jurisdiction of the courts of Germany, unless mandatory consumer protection laws in your country provide otherwise.
